Restoring Your Firearm Rights In WA State
In accordance with RCW 9.41.047 firearm rights restoration in Washington State is a process which involves petitioning the court to restore your 2nd amendment rights. Any person who fits the state’s eligibility requirements may submit a written request for a Supreme Court Judge to review for consideration.
The entire process can typically be completed in 30 to 60 days, however certain variables may prolong these timeliness. The most common issue is a conflicting matter on the client’s criminal history. Before I submit a petition I will first want to review your criminal history printout to see if certain convictions will need to be vacated or sealed.
How do I know if I’m eligible?Individuals with class A felony or sex offense convictions (unless juvenile) will not be eligible to have their rights restored. However if you have completed the waiting period and all necessary requirements under most circumstances, you will be eligible to reinstate your second amendment rights. We may petition to have your gun rights restored once the following requirements are fulfilled;
- You complete all terms of your sentence.
- You are crime-free for a waiting period of 3 years following a misdemeanor domestic conviction.
- You are crime-free for a period of 5 years following a felony conviction (Class B or Class C felonies only).
- Any no-contact / protection orders have been suspended or discharged. If not we will need to ask the issuing court to terminate the order.
- You do not have a prior felony prohibiting firearm possession.
Why will I need a criminal history printout?The criminal history printout must be submitted with your petition. It is also an essential document for me to review to determine if there are any matters you may not know about which could adversely affect a successful petition. In fact I recommend all of my clients take it upon themselves to retrieve this document prior to us meeting. Doing so will expedite the process once the ball is rolling and save you money on attorney fees.
Washington State Convictions

- Option 1: Getting a history printout for out-of-state convictions can delay the petition process since it requires submitting a request to the FBI. Fingerprints are required with this application and currently timelines average about 3 to 4 months. Learn more about FBI Identity Checks
